Jonathan Vilma Fights To Expedite Restraining Order Against NFL

As first reported yesterday, Saints LB Jonathan Vilma and his attorney Peter Ginsberg have filed a motion to expedite his temporary restraining order against the NFL for the 1-year suspension handed down for his alleged involvement in Greg Williams‘ pay-for-performance program. The motion says “Vilma will suffer real, immediate and irreparable injury in the absence of the injunctive relief sought” and requests a hearing as soon as the court’s schedule will allow. In a signed affidavit attached to this motion, Vilma said that the restraining order is necessary because, with the suspension, he cannot continue to recover under the aid of New Orleans Saints head trainer Scottie Patton.

Today, both Scotty Patton and Joe Vitt filed affidavits of their own in support of Vilma and his need for this temporary restraining order. In his, Vitt makes his strongest statement yet against the existence of an alleged Saints bounty system.

“While I anxiously await being able to provide substantive and truthful testimony and information about the allegations made by Mr. Goodell regarding the so-called but non-existent Bounty Program, and to refute that the Saints ever had a bounty on an opposing player and set out to injure anyone or to encourage any other Saints player to injure anyone, I will restrict my Affidavit here to issues that I have been informed are relevant to Mr. Vilma’s Motion to Restrain Temporarily the Suspension.”

Vitt goes on to say:

“The Suspension, and our inability to work with Mr. Vilma, in my opinion jeopardizes the entire Saints football team and our 2012 – 2013 Season,” Vitt said in the affidavit.

Vitt indicated he eagerly awaits the opportunity to give testimony on Vilma’s behalf in court. He said that Vilma “is one of the finest, fairest and most decent people I have ever known, both in and out of football and has been an ambassador for our game.”

In a motion filed earlier today, Saints head trainer Scottie Patton expressed his support for the restraining order by detailing Vilma’s recovery from knee surgery and the importance of his on-going rehab at the Saints facility.

“As a result of the Suspension, Mr. Vilma is barred from entering into the Saints training facility and, most importantly from my standpoint, the Suspension effectively prohibits my staff and me from assisting Mr. Vilma in helping him to recover from a serious knee injury,” Patton said in the affidavit.

In his affidavit, Patton repeated much of the injury history that Vilma put forth in his own signed affidavit, submitted on Monday. Patton said Vilma “seriously injured” his knee on Sept. 16 during a non-contact practice drill.
“I worked with Mr. Vilma two or three times a day starting immediately after his injury, generally beginning at 6:00 a.m. and again during mid-day,” Patton said. “It was vital for me to continually analyze his condition, work with him to strengthen his knee and to help him avoid additional injury.”
Patton said he is concerned that Vilma will push himself further than he should if Patton is not allowed to continue to monitor Vilma’s recovery.
“I also forced Mr. Vilma to miss practices when I deemed it necessary, something that Mr. Vilma constantly fought,” Patton said. “Indeed, one of my key responsibilities was to refrain Mr. Vilma from pushing himself too much, which is his tendency, as I have learned over the years. There was no doubt that Mr. Vilma would need to undergo major surgery during the off-season is (sic) order to repair his knee.
“In the middle of the Season, on November 8, 2011, Mr. Vilma underwent arthroscopic surgery in order to clean out floating particles from his knee. With the pain Mr. Vilma was suffering, and the condition of his knee, I doubt if Mr. Vilma could have continued to play without the arthroscopic surgery.”
As Vilma continued to recover, Patton said they worked four to five hours a day together toward rehab.
“Mr. Vilma was constantly pushing to life weights, run and do other conditioning exercises and I was constantly trying to restrict his activities. … Based on my experience, I do not believe most players would have continued to play due to the pain, which was increasing as the Season progressed.”
Patton said he had regular MRIs performed to check on Vilma’s progress.
“The types of benchmarks I regularly analyzed were: swelling; range of motion; pain; cartilage healing; and, quadriceps muscle strength,” Patton said. “… After carefully planned increases of his movement, we had a goal for Mr. Vilma to begin running lightly three months after surgery; after four and one/half months, our goal was for Mr. Vilma to begin side-by-side exercises; after five months, Mr. Vilma was scheduled to attempt sports-related drills; and, six months after surgery (this month), Mr. Vilma was scheduled to begin full activity. Mr. Vilma had difficulty moving on to the stage of full running.”
During the first week of July, Vilma traveled to Germany to undergo blood treatment performed by Dr. Peter Wehling. He said in his affidavit that the treatment allowed him to run for the first time in months.
Patton said he is concerned about Vilma’s condition if he misses all of training camp because of the suspension.
“If Mr. Vilma ultimately is permitted to play at the beginning of this Season, missing out on the rigors of training camp would expose him to a greatly increased risk of injury,” Patton said. “The conditioning to which we subject players during the training camp cannot be replicated at a later date.”

The NFL responded this morning to Vilma’s yesterday motion and called into question the validity of the claim that Vilma is barred from seeing Patton.

“Saints Training Camp does not even open until June 24 (sic). Under the CBA, no Saints players ‘are permitted to participate in any organized workouts or organized football activity of any kind … Moreover, Mr. Vilma’s Affidavit indicates that he is not ready to participate in Camp because he is still recovering from an injury , and has only recently begun to run again for the first time in six months.
“And Mr. Vilma is incorrect about the ability of the Saints medical staff to interact with him during his suspension; while Mr. Vilma may not attend the Club facility, he can rehabilitate and condition at a private facility and Saints trainers and physicians can monitor and help guide his rehabilitation there.”
The NFL also points out that Magistrate Judge Kurt Engelhardt first asked for motions of expedition in the matter on July 5, saying that Vilma’s 11-day wait “belies the supposed exigency of his motion.”
The league further reiterates that the court cannot hear Vilma’s case because it arises out of a labor dispute within the NFL collective bargaining agreement. It asks for the court to wait until at least Friday to consider Vilma’s motion because by that time, the league will have filed its motion to dismiss or for summary judgement in the matter.

The very detailed account by Patton is very interesting and shows Vilma’s intense eagerness to get back on the field. It’s hard to predict if this motion will be successful, but I admire Vilma’s tenacity in pursuing it. If he is impaired from rehabilitating his knee with Patton, this may cause long-term damage to his ability to play the game and may mean the end of his career. The NFL quaintly suggests that he can still rehab with Patton outside of the Saints facility somehow as if that’s just as good, but I don’t buy it.

People can say Vilma got what he deserved and they are entitled to do so. I would only urge them to read more into the details and not be so quick to believe the league’s carefully orchestrated but often proven to be mischaracterized side of the story. This matter all comes down to who you choose to believe – Vilma or the league office? I choose to believe Jonathan and hope he is successful in his fight to play this year and restore his good name.

Defending Your Life

I just thought I’d take this moment to address a few concerns and set the record straight. Because it seems I’ve upset more than a few Saints fans and received quite a bit of backlash for my witty (my own words) satire post titled “Drew Brees Suspended for Bountygate Involvement.”

Which I’m totally okay with. Because my writing is so bland and unobtrusive normally, it’s nice to be reminded that I’ve still got what it takes to ruffle some feathers. Makes me feel alive, like when people cut themselves on purpose.

But to those few people who completely missed the joke and felt the need to insult me via email, Twitter or message board, I have just one thing to say and I mean it from the bottom of my heart.

You’re not the brightest crayon in the box, if you know what I mean. I’m sure you don’t.

Sorry, but that’s the best I could come up with. Because I’m, like, not really that, like, smart and all…

Yes, that’s just some of the clever feedback I’ve received across the internet the past few days for my most recent satirical gem (my words again). I’m not going to link to any of these sources or tweets and give them the pleasure but I assure you they are all real.

Seems my “crude Brees joke…had poor timing.”

To start with the timing was in poor taste; they ran it before 3 PM yesterday when all the Saints fans were celebrating the fact that Drew Brees has just signed a deal committing the rest of his career to the New Orleans Saints.

Who would write such an awful thing?

But what’s interesting is that…

…that site seems to attract some odd Saints fans, most of the commenters thought it was funny, and a couple joked about Saints fans having to change their drawers after seeing the headline.

They thought it was funny!?!? You don’t say!?!? Wonder where they got that crazy idea!? Could it possibly be the fact that they actually got the joke?

So for all the geniuses who clearly missed the joke then decided to alleviate their confusion with anger, please allow me to explain:

1. In comedy, timing is everything and the timing on this one was necessary. There are some who thought I should have waited a day but I stand by my decision.

2. The post really has nothing to do with Drew Brees at all. It’s really an indictment on Roger Goodell and the entire Bountygate sanctions process. I merely used Drew’s signing as a vehicle for delivering my insult of the commissioner. It’s Goodell, after all, sounding like an idiot in the fake quote.

But many of you completely misunderstood or didn’t even bother reading past the headline and quickly flew off the handle erroneously. Instead of calling you names, however, and continuing to point out how you lack the sophistication it takes to truly get my genius (still my words), I’d like to turn this into a learning experience so that you don’t make the same mistake again.

Because I think you misunderstand just what it is we do here at Canal Street Chronicles. Contrary to popular belief, we are not the “National News Media.” That makes statements like the following absolutely untrue.

Whatever the Saints do, the media/haters will always throw bountygate somewhere in the reporting or comments, Roger GODell has ordered it so.

it’s possible that Dave Cariello may have been hired as the editor of the site simply because he had experience writing and editing, and in fact is not a Saints fan at all..

Again, we’re not the media. Our contributing staff is comprised of business owners, teachers, students, musicians and more, but none of us is the media. In four years I’ve gotten a media credential one time. It just happened to be for the best…game…ever.

Nor am I a professional writer/editor who was hired by a “big network of sports news sites.” I took one creative writing class in college. I majored in history and minored in philosophy. Never stepped foot in a journalism or English classroom. I’m just a nerdy Saints fan who started his own blog on Blogger four years ago and was lucky enough to get asked to join SB Nation.

And we’re not reporting anything. We’re not breaking stories. We’re not getting the scoop. We would love to, but we’re not. We’re just regurgitating actual reporting the professionals are doing or the random crap we find on the internet and speculating wildly about stuff we have no business even talking about. In short, we’re just like you.

We just happen to do it on a larger scale than most blogs. We happen to show up on Yahoo! and Sports Illustrated and the like. That’s just because we’re awesome at what we do, though, and not because we’re legitimate media. But it’s causing some of you to hold us to some higher standard and that’s a complete mistake on your part.

The other reason for misunderstanding my satirical posts is that a lot of you are simply not reading. Perusing a headline and assuming you know what a story’s about will catch up with you. Instead, read the entire article. Pause to digest and reflect upon what you’ve just read. Then, and only then, should you share your opinion with the rest of us.

Hey, I don’t mind criticism. After four years of doing this, I’ve gotten plenty and successfully ignored most of it. But I notice similar negative commentary around the web from time to time and I wanted to make sure I set the record straight.

I’m willing to bet a lot of other writers would probably love to address the idiocy of their readers from time to time but either don’t have the balls to do it or would get fired if they did. So let this post serve as proof that we can say or do whatever we want here at CSC because we are not the legitimate media and .

We’re just fans with a bigger platform.

Saints Sign Nick Toon

The New Orleans Saints have agreed to terms with wide receiver Nick Toon, their 4th round selection in the 2012 NFL Draft.

Greg Bensel was the first to break the news via Twitter:

Saints agree to terms on a four-year deal with 4th round pick WR Nick Toon

Financial terms, of course, were not made available.

Toon played his college ball at the University of Wisconsin. He is the final Saints draft pick to be signed, which means the team now has all five rookies under contract, just in time for the start of training camp at the end of the month.

Stranger Than Fiction: Coping With The Saints Turbulent Offseason

2012's moment of hope and unbridled joy for Who Dat Nation.

Hollywood moguls would laugh. Manhattan publishers would scoff. This story would never actually happen, try coming back when you have something a little more based in reality they’d say. Well, for Saints fans this is reality.

The last moment of pure joy and blissfully ignorant optimism as a Saints fan came with 1:37 left on the clock at San Francisco in the Divisional playoff. Watching Jimmy Graham race 66 yards down the field like a wrecking ball on fire. Knowing the Saints had just pulled off an unlikely comeback on a day that they did not have their best, or anything close to it. The “road” questions would end and the Saints best defensive opponent would be behind them.

Looking at it objectively, the Saints had all but sealed up the Super Bowl XLVI title with that score. The Green Bay Packers were absolutely, positively going to lose at home against the Giants the next day. Need proof? Stat time: the last defending Super Bowl champion to win a single playoff game the following season was the 2005 Patriots. Stats don’t lie, sorry 2012 Giants, it doesn’t look good for you.

The Saints weren’t going to lose a home game to anyone last season. The Giants would be dispatched in the Dome (again) and the Saints offense would likely overwhelm the Patriots under the roof at Lucas Oil Stadium. During that moment when Graham crossed the goal line at Candlestick all of these possibilities were a reality. That day was January 14th, over half a year ago.

Since then things have changed in dramatic and unimaginable ways for the Saints and their fans.

We aren’t going to get into the names and circumstances here. Frankly, we all know what has happened since the moment Darren Sproles completed the 2 point conversion on that Graham touchdown. The Saints family has been mired in a state of negativity that is unparalleled in NFL history. I, just like many others, can’t wait for the season to start and just get back to football. Win or lose we’ll have X’s and O’s to discuss again rather than prolonged contract negotiations and suspensions.

Drew Brees is signed and enough time has passed to cope with the suspensions and how to move forward from them. We move on from the allegations and the countdown to the 2012 NFL season begins. The question I have for my fellow Saints fans is: What got you through this tumultuous offseason? What could you hang your hat on? What was your silver lining in this enormous dark cloud since the Graham TD?

For me personally, I found solace in the Super Bowl XLIV title. Without that, I would have been crestfallen about the state of the organization and its future. To have been as good as the Saints have been in the Brees/Payton era and not to have won a title would have been devastating. Every successful franchise has their championship “window” and some succeed in it (Belichick/Brady Patriots) while others flounder in it (Rivers/Tomlinson Chargers). The Saints got theirs as the window had just barely begun to open wide.

If the Saints were still without a title by this offseason it would’ve seemed like it would never happen. Like that day against San Francisco was their best chance squandered. As if fate put greatness on our fingertips just to have it fall out of our hands (like a Saints defender going for an INT). Thankfully, as strange as this story has been it is far from over, and the Saints have an opportunity to write some amazing new chapters.

We as Saints fans don’t have to wonder what could’ve been regarding just winning a single title. We can afford to hope for multiple titles in this window. What Marino, Kelly, McNabb and many others wouldn’t give for the opportunity to say that. The ’09 title was like a kevlar vest against the bullets of this offseason. They still hurt like hell but they weren’t fatal. I knew that no matter what happened this offseason, we still saw the Saints win the title in our lifetime. They didn’t squander their best opportunity to get to the top, just the opportunity to top themselves possibly. Thankfully, the window is open wide and the Saints stand ready to cross through again.

Everyone’s predictions about the Drew Brees signing made this past Monday have finally been tallied, analyzed and formatted accordingly. They can be found in their entirety following the jump.

This was a tricky contest to judge so I’m including in the poll those participants who got at least one of their two predictions correct. The winner will be determined by you. When analyzing predictions, I used Chris Mortensen’s tweet at 12:34pm CST as our basis.
